Hansen-Mueller Still Owes Texas Farmers

LINCOLN, Neb. (DTN) -- Although Omaha-based Hansen-Mueller Co. has paid farmers in Nebraska for grain deliveries, producers and other businesses in Texas have yet to be paid, according to the Texas Department of Agriculture.

The Texas Department of Agriculture on Monday warned farmers and companies that still have not been paid for grain deliveries in the past 90 days to "immediately verify their delivery and payment status."

"TDA has received reports from Texas grain producers and companies that they are still owed significant compensation after recent grain deliveries or deposits with Hansen-Mueller," the state department of agriculture said in a statement on Monday.

Hansen-Mueller does not hold a Texas grain dealer license, as the company is licensed and operates under the authority of the USDA, according to the Texas Department of Agriculture.

Producers who have not received payment or "fear nonpayment" are urged by the state to consider filing a Uniform Commercial Code financing statement (UCC-1) with the Texas Secretary of State to protect their interests, the TDA said in a news release.

One week ago, the Nebraska Public Service Commission announced that 38 farmers who were owed about $2.1 million for grain deliveries had been paid by the company. Hansen-Mueller also agreed to provide financial statements and other information related to its business to the state in the coming weeks as a condition of the state halting the suspension of the company's grain dealer's license.

Hansen-Mueller operates elevators and merchandising offices in Council Bluffs, Iowa; Duluth, Minnesota; Houston, Texas; Salina and Kansas City, Kansas; Kansas City, Missouri; Sioux City, Iowa; Superior, Wisconsin; Tallulah, Louisiana; a merchandising office in Alabaster, Alabama; and a processing mill in Toledo, Ohio.

"I call on Hansen-Mueller to do right by our Texas producers and meet every outstanding obligation in full," Texas Agriculture Commissioner Sid Miller said.

"Our farmers deserve fair treatment and timely payment for their hard work. Anything less is unacceptable. I urge every grain producer who has worked with Hansen-Mueller to check their records, confirm delivery receipts and ensure they have proper documentation in place. TDA stands ready to support and guide our producers through this unfortunate situation."

The Texas Department of Agriculture did not immediately respond to DTN's request for more details about how many farmers and businesses in the state have yet to be paid.

As DTN has reported in the past few weeks, farmers in Kansas and Alabama have also reported not being paid for their deliveries by Hansen-Mueller.

Company officials have not responded to DTN's requests for comment.
